Hearings

Can I waive the hearing? Yes, but it is not recommended — the hearing is your opportunity to influence the decision.

Am I allowed to record the hearing? As a rule, you may record a conversation you are party to, even without prior notice.

Dismissal and resignation

Can an employee be dismissed during sick leave? No. It is prohibited to dismiss an employee during a period of illness for which they are entitled to sick pay.

Does resignation due to relocation entitle to severance? Under certain conditions yes — for example, a move of more than 40 km and where additional statutory conditions are met.

How long is maternity leave? A woman after childbirth is entitled to maternity leave of up to 26 weeks.

Pay and severance

Is a bonus included in severance calculation? Generally bonuses are not included, while fixed commissions may be.

What happens on company liquidation? The National Insurance Institute pays the employee a benefit for unpaid wages and severance up to the statutory ceiling.
